Reform to Florida Property Taxes

POTENTIAL PROPERTY TAX RELIEF REFORM 

            The Florida Legislature is currently working on a bill to lower property taxes.  A change to the Florida Constitution is also contemplated.  A plan is expected to go before voters in January 2008. 

            Under the proposed legislation as it currently stands, statutory reduction of property taxes is being considered as well as a cap on the amount of revenue which can be collected by cities, counties and special districts.  The reduction in revenue which can be collected by the various parts of government will be in proportion to the amount such revenue collection has been increased within a certain time period.  

            There are provisions, however, under which the local government can by vote increase the millage collectible, though politically this might be difficult for local government in the current climate. 

            The Homestead property tax exemption scheme is also under discussion.  There is a proposal to do away with the $25,000 exemption, and to replace it with exemptions based upon the value of the home.  There is also discussion of taking even stronger measures for seniors with low incomes. 

            Commercial properties would also receive an exemption based on the value of the property, and there is discussion of providing an even larger exemption for waterfront properties.

FIRST AMENDED COMPLAINT 

            Plaintiff, Overdeveloped Inc., an Oregon Corporation, by and through undersigned counsel, hereby sues Defendant, Internet Billing Company, LLC, d/b/a iBill, and in support thereof, states as follows: 

Parties, Jurisdiction and Venue 

1.         This is an action for equitable relief and damages exceeding fifteen thousand dollars, exclusive of interest, attorney’s fees, and costs. 

2.         Overdeveloped Inc. is a corporation organized and existing under the laws of the state of Oregon (hereinafter Plaintiff shall be referred to as “Overdeveloped”). 

3.         Upon information and belief, Internet Billing Company, LLC is a limited liability company organized and existing under the laws of the State of Georgia.  Upon further information and belief, Internet Billing Company, LLC is conducting business as iBill, and is registered to do business in the State of Florida (hereinafter Defendant shall be referred to as “iBill”). 

4.         Venue is proper in this Court as the original agreement between Overdeveloped and iBill, that forms the basis for the claims asserted herein, was created in Broward County, Florida; the agreement between Overdeveloped and iBill was meant to be and was carried out in Broward County, Florida; and the defendant is located in Broward County, Florida. 

5.         Overdeveloped has retained Michael D. Stewart, Esq., to represent its interests in this action and is obligated to pay him a reasonable fee for his services. 

6.         All conditions precedent to the bringing of this action have been satisfied, waived, and/or excused. 

GENERAL ALLEGATIONS 

7.         Overdeveloped entered into a certain service agreement with iBill wherein iBill agreed to provide Overdeveloped certain electronic billing and payment services. 

8.         Pursuant to the terms of the iBill Agreement, iBill agreed to accept and process payments from customers who purchased Overdeveloped’s services over the Internet (the “Customers”).  After deduction of certain fees, iBill agreed to remit the revenue generated through the Customer’s use of Overdeveloped’s services to Overdeveloped via periodic revenue payments.  iBill processed payments for Overdeveloped and remitted payments due to Overdeveloped until in or around September 15, 2004. 

9.         iBill owes Overdeveloped $64,988.45, which amount it has not paid. 

10.       As indicated on the computer “screen shot”, attached hereto as EXHIBIT A and by this reference incorporated herein, iBill acknowledges that it owes Overdeveloped $64,988.45. 

11.       Overdeveloped has been, and continues to be, damaged as a result of iBill’s failure and refusal to tender payment to Overdeveloped. 

COUNT 1 

Breach of Contract Against iBill 

            Overdeveloped realleges and reasserts the allegations set forth in paragraphs 1 through 11 as if fully set forth herein. 

12.       Overdeveloped and iBill entered into the Agreement for certain billing and payment services. 

13.       Pursuant to the terms of the Agreement, iBill agreed to process the revenue generated through the Customers’ use of the services. 

14.       After deduction of certain fees, as provided for by the terms of the Agreement, iBill agreed to remit the revenue generated through the Customers’ use of the services to Overdeveloped via periodic revenue payments. 

15.       Overdeveloped fully performed and complied with all of its obligations pursuant to the terms of the Agreement. 

16.       iBill breached the Agreement between the parties by failing to remit revenue payments to Overdeveloped consistent with the parties’ practices and in accordance with the Agreement between the parties.  As of the date of the filing of the instant action, iBill has failed to remit the $64,988.45 owed to Overdeveloped. 

17.       As proximate result of such breach, Overdeveloped has suffered and continues to suffer additional damages. 

            WHEREFORE, Plaintiff Overdeveloped hereby demands judgment in its favor against Defendant iBill for damages caused by iBill’s breach of the Agreement between the parties. 

COUNT II 

Unjust Enrichment Against iBill 

            Overdeveloped realleges and reasserts the allegations set forth in paragraphs 1 through 17 as if fully set forth herein. 

18.       Overdeveloped allowed its Customer payments to be processed through iBill’s services. 

19.       It was agreed at the time the Customer payments were being processed, that iBill would be making periodic revenue payments to Overdeveloped consisting of these Customer payments, minus iBill’s service fees. 

20.       Despite receipt and acceptance of such Customer payments, iBill has failed to provide Overdeveloped the revenue payments to which Overdeveloped is entitled. 

21.       As a result of acceptance of these Customer payments without making the required periodic revenue payments to Overdeveloped, iBill has been unjustly enriched. 

22.       The revenue payments are specific and identifiable property and/or can be clearly traced in iBill’s assets. 

23.       As a direct and proximate result, Overdeveloped has been damaged. 

            WHEREFORE, Plaintiff Overdeveloped hereby demands judgment against Defendant iBill in the amount of $64,988.45, together with post-judgment interest at the statutory rate.
